Terms of Use

By downloading, accessing, or using the OpenCrumb mobile application, you agree to these Terms of Use.

Effective Date: October 12, 2026
Last Updated: October 12, 2026

Introduction

OpenCrumb is operated by Craft Code LLC, a Florida limited liability company.

OpenCrumb is a discovery platform that helps users find and connect with independent local food stands and cottage bakeries.

We do not manufacture, prepare, store, package, inspect, or sell any food products listed through OpenCrumb. Stand owners are responsible for their own businesses, products, and compliance with applicable laws.

If you do not agree to these Terms, please do not use the application.

User Accounts and Conduct

Some OpenCrumb features require an account. When you create an account, you agree to provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree not to use OpenCrumb to engage in unlawful, fraudulent, abusive, or harmful activity; interfere with the operation or security of the application; attempt to gain unauthorized access to accounts or systems; or misuse OpenCrumb in a way that could harm other users, stand owners, or the service.

Violations of these Terms may result in removal of content, restriction or suspension of access, or termination of your account.

Stand Listings and Transactions

Stand owners are independent operators and are not employees, agents, or partners of OpenCrumb or Craft Code LLC. Stand owners are responsible for the accuracy of their stand listings, the food products they offer, their business practices, and their compliance with applicable laws and regulations.

When you purchase or arrange an order with a stand owner found through OpenCrumb, the transaction is between you and that stand owner. OpenCrumb is not a party to transactions between users and stand owners, and we do not process payments, handle refunds, or guarantee the quality, safety, or legality of any food products.

OpenCrumb provides information to help users discover local stands, but we do not guarantee that a stand will be open, that listed products will be available, or that information provided by a stand owner will always be complete or accurate.

Stand listings may include links to third-party websites, social media accounts, or online ordering services. OpenCrumb does not control these third-party services and is not responsible for their content, availability, privacy practices, or transactions. Your use of third-party services is subject to their own terms and policies.

Stand Owner Subscriptions

Certain stand-owner features require a paid subscription. Subscription pricing, billing frequency, renewal terms, and any applicable trial terms will be shown before purchase.

Subscriptions are purchased through the Apple App Store or Google Play and are billed and managed through the applicable app store. Subscriptions are also subject to the applicable app store's terms and policies. You can manage or cancel your subscription through your app store account.

Canceling a subscription does not automatically delete your OpenCrumb account or stand information. Access to subscription-required stand-owner features may end when your paid subscription or trial expires.

Deleting your OpenCrumb account or removing a stand does not cancel a subscription purchased through the Apple App Store or Google Play. You must cancel that subscription through the applicable app store if you do not want future renewals.

Intellectual Property and User Content

The OpenCrumb name, logo, application, design, and original content are owned by Craft Code LLC and may not be copied, reproduced, or used without permission except as allowed by law.

You retain ownership of content you submit to OpenCrumb, including photos, descriptions, and other stand information. By submitting content, you give OpenCrumb permission to use, display, reproduce, and distribute that content as necessary to operate, provide, and promote OpenCrumb, including on OpenCrumb's website, social media, app store listings, and other marketing materials.

OpenCrumb does not claim ownership of your content and will not sell or license your content to third parties for their independent marketing or advertising purposes.

You are responsible for the content you submit and must have the right to use and share it. OpenCrumb may remove content that violates these Terms, applicable law, or the rights of others.

Disclaimers and Limitation of Liability

OpenCrumb provides the application and information available through it on an "as is" and "as available" basis. We do not guarantee that the application will always be available, uninterrupted, or error-free, or that information provided by stand owners will always be accurate or current.

OpenCrumb does not inspect, prepare, manufacture, or sell the food products offered by stand owners. We do not make guarantees regarding the quality, safety, ingredients, allergens, legality, or suitability of food products offered by stand owners.

To the fullest extent permitted by applicable law, OpenCrumb and Craft Code LLC are not liable for losses, damages, injuries, or claims arising from transactions or interactions between users and independent stand owners, food products purchased from stand owners, reliance on stand listing information, third-party services, or the use or inability to use OpenCrumb.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of these Terms.

Additional Terms for Stand Owners

These Additional Terms for Stand Owners apply to anyone who creates, manages, or operates a stand listed on OpenCrumb. They apply in addition to the OpenCrumb Terms of Use above.

By creating a stand on OpenCrumb, you acknowledge that you operate your business independently from OpenCrumb and Craft Code LLC. You are not an employee, agent, partner, or representative of OpenCrumb or Craft Code LLC, and neither OpenCrumb nor Craft Code LLC operates or controls your business.

You are responsible for your stand, the food products you offer, your business practices, and your interactions and transactions with customers.

Legal and Regulatory Compliance

As a stand owner, you are responsible for understanding and complying with the laws and regulations that apply to your business and the food products you offer.

By creating and operating a stand on OpenCrumb, you attest that:

  • You operate your business in compliance with applicable state, local, and other food laws and regulations.
  • You have obtained any permits, registrations, licenses, food-safety certifications, or other approvals required for your business.
  • You will only offer food products that you are legally permitted to sell.
  • You are responsible for complying with applicable requirements related to food preparation, handling, packaging, labeling, and sales.

OpenCrumb does not verify your licenses, permits, certifications, or legal eligibility to operate. Listing a stand on OpenCrumb does not mean that OpenCrumb has inspected, approved, licensed, or certified your business or food products.

Stand Listing Accuracy and Owner Content

Stand owners are responsible for the accuracy of the information they provide through OpenCrumb, including their stand name, location, description, photos, Today's Note, offering categories, payment methods, and any links they choose to provide.

You agree not to provide false, misleading, unlawful, or inappropriate information or content through your stand listing. You must have the right to use and share any photos, text, or other content you submit.

Stand owners are responsible for keeping their stand's open or closed status as accurate as reasonably possible. If you close your stand earlier than expected or stop operating for the day, you should update your stand's status in OpenCrumb. OpenCrumb may automatically close a stand in the app at the end of the applicable daily operating period.

OpenCrumb may remove or restrict stand listings or content that violates these Terms, applicable law, or the rights of others.

Food Safety and Customer Information

Stand owners are responsible for the preparation, handling, storage, packaging, and labeling of the food products they offer and for following applicable food-safety requirements.

Stand owners are responsible for providing any ingredient, allergen, labeling, or other product information required by applicable law. Customers with questions about ingredients, allergens, or food preparation should communicate directly with the stand owner.

OpenCrumb does not prepare, handle, inspect, test, or verify the safety, ingredients, allergens, or labeling of food products offered by stand owners.

Transactions and Customer Relationships

Stand owners are responsible for their own sales, payments, pricing, refunds, order fulfillment, customer service, and any other transactions or arrangements with customers.

OpenCrumb does not process payments between stand owners and customers and is not responsible for resolving disputes arising from purchases, orders, payments, refunds, or other interactions between stand owners and customers.

If you provide a link to an external ordering, payment, social media, or other third-party service through your stand listing, you are responsible for your use of that service and for ensuring that the link and information you provide are appropriate and accurate.

Subscription and Stand Access

Maintaining an active stand on OpenCrumb requires an active stand-owner subscription or applicable free trial.

If your subscription is canceled or otherwise ends, your stand information may remain stored in OpenCrumb, but you will not be able to open your stand or use subscription-required stand-owner features after your paid subscription or trial expires.

You may permanently remove your stand separately from canceling your subscription. Removing a stand deletes the stand and its associated stand information but does not delete your regular OpenCrumb user account.

Reports, Enforcement, and Removal

OpenCrumb may review reports or other concerns regarding a stand, its listing, or content submitted by a stand owner. A report does not automatically result in removal of a stand or account.

OpenCrumb may remove content, restrict a stand's visibility or access to stand-owner features, or remove a stand from OpenCrumb when reasonably necessary to enforce these Terms, comply with applicable law, or protect users or the service.

Serious or repeated violations may result in suspension or termination of the stand owner's OpenCrumb account.

Authority to List and Operate a Stand

By creating or managing a stand on OpenCrumb, you confirm that you are the stand owner or are authorized to act on behalf of the business.

You are responsible for ensuring that you have the right to operate at the location you provide and to submit the information, photos, links, and other content included in your stand listing.

Stand Location

Stand owners are responsible for providing an accurate location for their stand and for having the right to operate at that location.

You understand that the location you provide will be used to show your stand's location on OpenCrumb and to provide customers with directions to your stand. Your street address will not be displayed as text on your public stand profile.

Stand Review and Approval

New stands may be reviewed by OpenCrumb before they are approved to open or appear to customers.

Creating a stand does not guarantee that the stand will be approved or listed on OpenCrumb.

OpenCrumb may decline or remove a stand that does not meet these Terms, is not appropriate for the OpenCrumb service, or raises legal, safety, or other legitimate concerns.
